You opt in by providing your mobile phone number and checking the text-message consent box in the BetterNOI online application, or by asking a leasing agent at the property to contact you by text. Before any other message is sent, you receive a text confirming that you are signed up and explaining how to opt out. Once you opt in, you consent to receiving text message communications from us regarding your account, including application and screening status updates, document and verification requests, lease and renewal notices, and other service-related updates.

Messages are sent by BetterNOI and may identify the property community you have applied to or reside at.

Consent to receive text messages is not a condition of any purchase, application, or service, and you may revoke your consent at any time as described in Section 4.

2. Compliance with Applicable Law

We adhere to all applicable laws, including the Telephone Consumer Protection Act (TCPA) and the Fair Credit Reporting Act (FCRA). Our communications will remain professional, lawful, and non-abusive. We will not use threats, harassment, or misleading language in our messages, and we will respect your right to limit or revoke consent at any time.

3. How We Collect and Use Your Information

When you opt in to receive text messages, we collect the following information:

• Your mobile phone number
• The date, time, and content of the messages exchanged
• A record of your opt-in and any subsequent opt-out, including the date and time, the method used (online application or leasing-agent request), the consent language presented to you, and, for online opt-ins, the IP address of the device used
• Delivery status information returned by your wireless carrier
• Any responses or preferences you provide regarding text communications

We use this information solely for communication related to your account, including:

• Notifying you of application and screening status
• Requesting documents or information needed to complete your application
• Providing lease, renewal, and other service-related notices
• Offering assistance regarding your account

4. Opting Out of Text Messages

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. You will receive a confirmation message, after which you will no longer receive text communications from us, except as required by law or in response to inquiries you initiate. If you wish to opt back in, you may contact us directly or ask your leasing agent.

You may reply HELP to any message at any time to receive support information.

5. Message Frequency and Charges

The number of messages you receive may vary based on your account status, the services associated with your account, and your preferences. Standard message and data rates may apply as determined by your mobile carrier. We are not responsible for any charges incurred from text communications.

6. Sharing of Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

We use third-party messaging service providers to deliver text messages on our behalf. Information shared with that provider is limited to what is necessary to deliver messages to you and is subject to contractual confidentiality and security obligations.

Where your application or account relates to a property owner or management company that uses BetterNOI, account information may be shared with that company in the ordinary course of providing our services to them. This does not include your text messaging opt-in data or consent.

We may also disclose information where required by law, subpoena, or other legal process.

All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Data Retention

We retain text message records, together with associated opt-in and opt-out records, for seven (7) years, or longer where required by law or necessary to demonstrate compliance with applicable regulations. Opt-out records are retained for as long as necessary to honor your request.

8. Security and Confidentiality

We take reasonable measures to protect your personal information from unauthorized access, disclosure, or misuse. However, please note that text messaging is not a fully secure form of communication, and we encourage you to avoid sharing sensitive personal or financial information via text.

9. Changes to This Policy

We reserve the right to modify this Privacy Policy at any time. If changes are made, we will notify you by updating the "Effective Date" above and, where required, by providing additional notice.
